Abstract:
The basic element that human beings looks for the security after getting
physiological needs such as nutrition, harbouring. Crime is phenomenon gives harm
to necessity to trust of human being and has so many dimensions such as historical,
sociological, legal and psychological. Crime, as a reality for humanity history, has
done against all kind of being by the people again. Punishment is a justice
application applied by great legal ecoles in the historical period. By this way, while
crime is an activity that is given a punishment by authoritiy, punishment is a
precaution against crime and supplies regulation for societies. Searching these
phenomeons and studying their roles in the historical period, serve as examples for
legal practices of modern states.
In this research, crimes and punishments given to them during the XVIII.
century is examined versatilely at Ruse which was a place at the Ottoman Empire.
Research has three chapters with an introduction and the result. In the first chapter,
theoretical and methodological infrastructure is constituted by explaining source
value in terms of usage of legal history of court registers that are the basic source of
the work. In the second chapter, crimes were done in the XVIII. century at Ruse with
a whole view is explored; after that the elements affecting the crime are examined
which is an important issue. After that, the punishments applied against criminals at
Ruse are investigated. In the third and the last chapter, the elements of crime and
punsihment are approached in terms of different parts of society and the prudent
generalizations are done.
This study is a trying that examines crime and punishment practices of a
rural place of Ottoman Empire, struggling methods against these elements and the
effects of them for society by analyzing court registers. In the study, also, the
relations of state-rural are mentioned. By this way, the records of Ottoman court at
the Ruse in XVIII. century are revealed by examining the history of these elements in
terms of crime and punishment.
