Özet
The concept of medical intervention encompasses a wide range of activities, from simplest treatments to the surgical procedures. Although these activities are performed with the aim of benefiting individuals, they constitute an infringement on bodily integrity. Therefore, it is clear that medical interventions must be subject to legal regulations with various conditions in order to protect fundamental rights. Accordingly, when examining whether medical interventions constitute an infringement on bodily integrity, it must be considered whether the regulations on medical interventions in the legislation meet the requirements of the principle of legality. On the other hand, the participatory physician model requires that the person undergoing medical intervention be informed beforehand and give their consent to the intervention. When the institution of consent is evaluated within the concept of public order, the question of whether medical intervention can be performed without obtaining the consent of individuals may be raised. This study was prepared with the aims to carify the circumstances under which medical interventions may be performed without seeking the person's consent. Due to the comprehensive nature of the relevant situations, a non-exhaustive approach was adopted in this study.
