Özet

This paper aims to analyze the Constitution of 1982 drawn up after the coup d'Etat of 12 September 1980 and military government practices, regarding fundamental rights and freedoms from Foucault's analysis on the law/power relationship. Foucauldian thought of power and subjectivization practices were first examined, the position of law in power relations was determined thereafter. Based on Foucauldian theoretical framework, the role of law in power relations and its special position towards fundamental rights and freedoms after the 1980 coup d'Etat were revealed.
